As they should - the whole GST failure to pay is a total disgrace.
As a future potential workplace I wouldn't sue them and if everyone sues them and they didn't have the money to pay them, I just think that means no one gets paid but this is the only organization trying to pay them what they are worth.
Its incredible that GST get kudos for this when the fact is GST is paying them 0 for their participation and wins, while they actually get money from Diamond League. Paying 0 = trying, but paying €€€ is not?

I'm just saying if they do find proper funding and the league returns next year, pros will want to race for the $100k not $15k.
They can pierce the corporate veil and sue MJ personally if they can show gross negligence, willful misconduct, or criminal intent to defraud. But that is a tall order to prove, and will likely need to get an "insider" to provide documentation and/or testimony. And the only way that happens is if the Justice Department threatens criminal charges against one or more of the other GST executives.

I think the only documentation needed is the funding agreement with Winners Alliance. It will show that Johnson promised appearance fees and prize money based on funds that were entirely optional. It wouldn’t be criminal intent, but the other two possibilities you listed might gain traction in court.
Reminds me of some garbage that Larry Barthlow pulled with athletes in road races years ago. The Kenyans would get paid out but if an American athlete cashed in the event in the Top 10 and didn't run some insane time he tried to blow off paying them. If you make the money you make the money. For example if you are a poker player and play in a $100K guarantee that expects 500 entries but only gets 50 enter they still pay out the guarantee. If you promise prize money and don't pay it out you fork up the difference. If this is on MJ then well looks like his net worth is going to dissolve. He between be using that $10 million plus net worth to pay out the athletes as agreed.
Michael Johnson’s GST said it was ‘categorically false’ he had pocketed $2m from the series while his athletes were unpaid – and that he was facing losses
Obviously this is an article about a denial of a figure of 2 million dollars but these would be my observations.
1) This seems like a plausible "salary" a founder of CEO would think they are entitled to with a potential 30 million dollars of funding and the belief of a long-term successful venture (which I believe he was deluded enough to think it always way)
2) That figure has come from somewhere and most likely a former employee. Any time a figure is released it hasn't just been pulled out of thin air.
3) I already believe there is a lie involved in the response from Johnsons team - I find it hard to believe quote “In fact, Michael has actually put over $2m of his own money into the project." (from a "representative" of Johnsons). That I do not believe one bit.
I think the truth lies in what you believe the character of Michael Johnson to be. I personally have heard a lot about that character from his competing days from people who I believe to be very credible sources. I don't have a lot of trust in Michael Johnsons character that's all I would say from my side.
I feel bad for Agnes Ngetich (sp?). She ran her heart out to win GST races and made them very exciting to watch. And she got nothing for it. Tried to peak again months later for worlds and came up just short of a medal. If it were up to me, she'd be the first one to get her money under the honest effort clause.
