You are completely wrong. The courts long predate any existing American statute, and that includes all their basic customs and procedures. Justice is founded on many centuries of precedent that cannot easily be legislated away.
That's why every new statute immediately comes under intense scrutiny and gets dragged into the courts. If it comes down to it, SCOTUS could be made to strike down a "sandwich felony" statute.
While you may not like that, it's actually a damn good thing - state legislators are not usually very smart, and are often half-wit crusaders who don't care if what they do makes any sense.
What's probably happening here is some kind of vaguely-worded escalation clause, like "serious bodily harm," or an automatic upgrade for anything done to a police officer. The DA may claim the sandwich could have hit the cop in the eye and blinded him. That's the problem with the courts - the whole system is about pitting lawyers against each other to lie about whatever happened.

- Eat at Subway
