You can try to structure something into the divorce settlement, but if her lawyer has two brain cells, he’ll realise that the name is valuable to you / your business. The lawyer will try to extract as much value from you in exchange for her dropping the name. Just bringing up the topic will probably tip her and her lawyer off as to it’s value. Whereas if you just leave it alone, then - unless she’s going to launch a competing business - there’s probably no harm in her signing her monthly check to the water company with your name. In fact, if you get into a public spat over the use of your name, that alone could make you look petty and damage the brand/business more than just getting a quiet divorce.

The advice you are getting is consistent and perhaps a little disappointing. What ever you do, don't fall into the temptation of murder.
