We would need to ask the DA about it but if I were the judge and heard the prelim for Rossi's wife beating trial and the DA told me that they need a continuation of the case because the wife has to get surgery, I would automatically grant the continuation and move the case onto a full trial. From the court documents, the next court date could possibly be the full trial. A commonsense judge that learns that the beaten up wife can't attend court because she needs surgery would be able to put 2 and 2 together about the seriousness of the case. Rossi just looks like an even bigger douchebag with this bit of information.

i know the US health system isnt great but waiting almost a month for facial surgery seems like a long time to me.

also, i dont think a judge is supposed to put 2 and 2 together. rather isnt it their job to deal with the evidence at hand?

Questions to the DA could clarify if the surgery is related to the case, but what are the odds? Also, for plastic surgery to the face, I don't think you can do the fine detailed work on bruised/pulverized tissue/bone. You have to let the tissue at least heal somewhat. Cutting and sculpting dying facial tissue doesn't work too well. That could explain why there is surgery near now and it could have been more than one visit to the surgeon and you also have to allow for time to heal after the surgery so 1 month is actually pretty realistic for a beating.

The judge is actually supposed to make his or her judgement call at the prelim whether there is enough evidence to let the case go forward. Courts have tons of discretion and human judges will always make these types of connections because only a fool would not see it and all why she is having surgery.

Facial surgery often requires the injuries to be healed to a certain degree to see the level of injury and remedial work required before proceeding further.

The judge is supposed to "put 2 and 2 together" and "deal with the evidence at hand" and in this case did that and decided it should go to trial.

At the trial witnesses and evidence will be heard to decide an outcome.

Whoops! Getting drunk isn't a valid defense, Rossi, for punching your wife in the face. That fake Facebook "apology" about alcohol isn't going to help you now so you might as well get back on Facebook, again.

I wonder what excuse Rossi is going to come up with for punching Cindy in the face now that we know getting drunk is not an accepted defense for simple assault in Philadelphia. I think that fake Facebook apology from Rossi could become a key piece of evidence to show that he at first tried to use the drunk excuse before switching to another excuse. It would undermine Rossi's little credibility in the court room. I hope the DA is sharp enough to pick up on this.If Rossi sticks with the non-accepted being drunk excuse, it will be a pretty quick court case with him being found guilty and wasting the court's time. Knowing Rossi, he's going to try to throw Cindy under the bus (figuratively, I hope) and say she provoked him and started the fight as his new defense, thus increasing Rossi's douchebag level even higher as Cindy and other evidence prove him wrong.
