It is literally a legally established right, in section 107 of the copyright act. And legally, "Fair use applies when journalists use copyrighted material as documentation, to validate, prove, support, or document a proposition." And this literally investigative journalism. Niche, for sure. But still journalism. He should be attributing the pictures, but he certainly has the legal "right" to use them.
