The New York law was written to explicitly criminalize fraudulent statements in obtaining a loan even if the loan is paid back and the lender suffers no loss under the terms of the loan. I have no comment regarding whether it is a good law, but it has been used hundreds of times in New York so Trump and his advisors knew or should have known that lies in connection with a loan application created a risk of prosecution. People can't claim that his is smart and a sophisticated businessman and then excuse him -- a man who has borrowed vast sums for years -- for not knowing the rules in his home jurisdiction.
Meanwhile, the case is being dismissed and he was never sentenced...

The case hasn't been dismissed. The court has asked both the prosecution and the defense to submit arguments about whether it should be dismissed. The defense is being allowed to submit their arguments with a renewed request to dismiss the case.
The tea leaves aren't clear. The court may be considering dismissing the case, or it may be taking the extra precaution of additional briefing due to the intervening SCOTUS opinion on immunity. Meanwhile, Trump is a convicted felon at this point because a jury convicted him of a felony. This is true regardless of whether the sentence is passed now or deferred to a later date. The only thing that could change that fact would be reversal by a higher court or a dismissal of the case.
