The legal problem for Big'Ole Murphy is that he has turned it into a business. He solicits "donations" on his web postings where he is illegally posting clearly labeled copy righted material. He solicits and is a contractor for races to hire him as a race marshal.

If I was photographing runners and trying to sell those pictures then I wouldn't be happy that someone is stealing my work in order to target my potential customers.

If Derek needs to use pictures during his investigations then he should use his own cameras during races and stop stealing the work of others.

Please refer to the Fair Use exception. Fair Use applies in this case. The purpose of posting her photos was to comment on them in the context of the article which is allowed.

Additionally, I purchased the photo used in this article.

That's from the article that still has pictures.

If he paid for them then I suppose he can post them but I don't think he can while receiving commercial benefit which is what it his website has morphed into. The marathon photo license information is kind of murky. He has posted photos that still had the water marks on them. That means that he copied them rather than purchased them. He is using marathon photo's work (taking pictures, posting and web hosting) to gather data on suspected cheaters. Unless he is reimbursing the photographer or has received permission to use their body of work in this manner then he is stealing. Kind of sounds like what bandits or bib copiers do. Neither of those activities is ethical.

So it seems this thread has reached the point where people who don't like Derek and don't understand how copyright law works are posting crackpot legal theories.

I don't think the cheaters are capable of understanding the concept of fair use. To them all news and media is concocted propaganda to sell something. They simply can't understand screenshotting something to then write objective commentary about it. These are liars who have doubled down on their cheating such that they will attempt to use legal scare tactics on journalists with zero guilt over the fact that they are doing so to defend their own very real and illegal fraudulent activities.

The reason these cheating threads always blow up into way more posts than we ever would have imagined is because the narcissistic cheaters come here and try to ensure they have the final word on influencing everyone's opinion. Any other thread on LRC dies off after a while when normal people can allow their opinion to exist in the presence of other opinions. These narcissists simply can't continue with the thought that somebody might not buy the imagine they want to project.

I don't have a problem with Marathon Investigation. I do have a problem with some of the crazies that post on cheating threads here.
