Oscar Ponce on the run from police

Ponce is American, by the way.

For a while Ponce lived around here and I can remember saying to someone "dude, is that the guy from that book?"

I'm wondering the answer to this as well. The stories in the news seem to have gone cold. And Ponce probably isn't exactly a high profile fugitive outside of the RWTB fanboy sites.

If ponce gets found and gets convicted for sex ...position of trust with a 17 year old, consenting.. What kind of sentence do you think he would get? 1 year, 5, 10?

Can the fact that he went on the run be used against him if this case goes to trial? Or is that dealt with separately?

Fortunately I have never had to be involved with getting bailed out of prison. Do any of you legal types know whether or not his "being on the run" actually an issue as long as he shows up in court on 12/28? I don't know if it is a condition of bail that you remain in contact with the police or court before your scheduled hearing.

The judge will usually issue stipulations with bail. Surrendering a passport is usually a given. Oftentimes, if the accused is local, they will be told to stay inside the city or town they live in, sometimes the state. They also need to make themselves available for future communication, such as being charged with another crime, as is the case here. in addition to this, a bondsman, who has usually ponied up 90% of the bail, can add stipulations to make sure you show up to court and they get their money back. While I don't know the particulars of this case, I think it's safe to say he has violated conditions of his bail judging by the news reports.

Whilst it was wrong to do what he did, I and many others I'm sure can differentiate between having consensual sex with a 17 year old versus with a child. In my eyes 17 is a young woman.

From what I just read Colorado law says the age of consent is usually 17.

If you're under 15 and the person your having sex with is less than 4 years older than you its legally ok. Otherwise its a class 4 felony.

If your 15-16 and the person is not 10 years older than you its legally ok. Otherwise it is a misdeamor and you are sentenced more harshly.

Now Oscar has quite a few things going against him if the charges are true.

1) One of the victims was apparently under the age of 15. That right off the bat makes it a class 4 felony.

2) He was in a position of trust (as a coach) that bumps it up to a class 3 felony.

says a class 2 felony gets you 8-24 years in prison but that does not include felony sex cases where the penalty is harsher.

Some defense attorney could probably chime in here to say what he could plead to and what sort of sentence he might get.

This does not just involve sex with a 17 year old (which would be legal in Colorado). He was a person of trust and one of the alleged victims was 14. He could do significant jail time if convicted.

You cant just stick a number on it. It really depends on the individual.
