Come on, he like all the pro (and probably sub elite) US athletes are on a number of different drug to keep their performance up, muscle mass, energy levels in the right place.

The powerhouse countries just use different than EPO and testing has not caught up with all the substances that should be banned.

I've been defense side against the feds a couple of times, and I have real issues with overcriminalization and vague statutes that allow the feds to go after anything they decide is "bad behavior," but I don't think a wire or mail fraud prosecution for doping would be a stretch at all. You're absolutely right that they haven't done it, but that's an issue of resources and priorities. I would not expect any court to dismiss a fraud indictment in a standard doping situation (not that I wouldn't try).
