When nike can afford to make that claim in court, yes. Double bonus points for more legal costs for BB.

I'm clearly confused. May I just ask this, if Nike has the right to match any offer Boris receives doesn't Boris have the right to decide which company he wants to sign with? Say the contract is matched but he prefers one over the other, has he no bargaining power or choice? Is he bound to Nike? It sounds like baseball before free agency where you are bound to a team in perpetuity.

According to the brief, under the 2015 contract he signed with Nike, he agreed to give Nike the right to match any offer. So he gave up some of his right to choose which company to sign with.

Yeah, understand the legal strategy, but not with that argument. That is too easily disproved. If Boris has no contract with NB and is not being paid by them how can he be "endorsing" them? In other words, just wearing their products can't constitute an endorsement.

Even with the NB logo covered BB would be competing in "athletic gear from a competitor"? It seems like the wording does not limit to just gear with a visible logo .
How deep in the athletic gear/wear marketplace does BB have to go to get to a non-competitor of Nike.

Not a lawyer, but I would imagine if Nike is accepting that Berian has not signed a new contract, they would have an even weaker case.
To me, a right to match, is not a right to force a renewal in the case of no such offer. If absent an offer, a renewal can't be forced, the contract would simply be expired -- in which case Berian could do what he wants.
The peeps calling Nike thuggish on this thread are the same people who expect a pro athlete to take a paycut and stay in their adopted home city rather than go elsewhere in free agency for more money....yet they would never themselves take a paycut for a job.

I think several times along the way he decided to provoke them. So what did you really expect to accomplish here.
Nick is probably more than happy to have the competition out of the way. Most of the anti-nike people have had their glory days and most of them with Nike. So it cost them nothing to have Berian sacrifice.
