However, based on the way he keeps trying to cover things up, I think that he does remember the incident.

Do you know what facts are? You realize that every day there are endless tickets given out by police based upon what they observe only. “I saw this person make an illegal left turn”. No corroborating evidence, just the police officers word. A lot of those tickets so go to trial and the driver denies it. What does a judge do? The judge has to decide who to believe.

Oral evidence are facts. You can decide you don’t believe her and prefer his evidence, that’s fine. In reality if this were a trial I think for sure he would have raised a reasonable doubt. Doesn’t mean he didn’t do it, it just means with the evidence at hand I wouldn’t convict. But, with regard to his candor and how he handled the questions - I would not vote to appoint him to the Supreme Court. Can you imagine if someone in his courtroom answered his questions with questions and was otherwise so evasive on other questions? As a judge he’d know what that meant.
