While the Supreme Court hasn't directly ruled on the legality of gun ownership by noncitizens, in McDonald v. City of Chicago the Supreme Court ruled that the second amendment is incorporated under the due process clause of the 14th amendment (which applies to citizens and non-citizens), rather than the Privileges or Immunities Clause, which explicitly applies to citizens (see Thomas' concurring opinion).
While McDonald v. City of Chicago incorporated the Second Amendment under the Due Process Clause of the Fourteenth Amendment, it did not explicitly address gun ownership rights for non-citizens. Federal law, such as 18 U.S.C. § 922(g)(5), restricts firearm possession by certain non-citizens, reflecting congressional intent to limit these rights. Although the Due Process Clause can extend some constitutional protections to non-citizens, this does not guarantee unrestricted Second Amendment rights, and courts have not conclusively resolved this issue. As I said, this hasn't been tested in the Supreme Court, and I'm not sure where the current court would fall (they are loathe to restrict gun rights, but I could see them arguing via the Privileges or Immunities Clause that the second amendment only applies to citizens).
But, there's no similar questions regarding the application of the fifth amendment to non-citizens, so for the case at hand it's rather a moot point.
