Not sure what you mean by bait and switch in this context, but here is some actual data. This study was conducted by Cato, which is a well-known conservative/libertarian think-tank. Data is from ACS so it is probably as reliable as anything out there.
Looking at 3 groups overall, legal immigrants have the lowest incarceration rates, followed by illegal immigrants, with natives the highest. However, there is considerable variation by region of origin.
