The "gender test" for sporting events SHOULD BE ARBITRARY.
A diverse panel should be convened, and the majority vote on a simple M-F question should decide. No abstentions.
Easy. Quick. Infallible by definition.
And unappealable, except for procedural grounds--e.g. the cast votes were improperly communicated, or tabulated.
Why do most people seem to be afraid of a decision based upon arbitrary standards? It is sports, it is essentially unimportant on a policy level. A large enough and diverse enough panel, combined with transparent vote tabulation, substantially lessens the potential for abuse.
To be eligible to vote, panel members must at a minimum have been exposed to at least one photo of the athlete in question. There would be no pre-approved photos, but each vote would have to be accompanied by at least one photo, to provide evidence that something relevant was considered.
The decision would still be arbitrary even though evidence was examined, as there would be no articulated standards as a basis for decision.
For truly important purposes, other tests could be used, potentially yielding different results appropriate to the problem to be addressed.
It should not be up to sporting administrative agencies to provide society with decisions based upon their symbolic importance.
They should be restricted to providing an individual athlete with a decision based upon its athletic competitive importance.
