More accurately, WADA lost CAS appeal, rather than Scherf won.
Scherf had a one year suspension. WADA thought that it should be two and appealed. CAS denied the WADA appeal. Scherf still has her one year suspension.
All true. But you should add that CAS wanted to reduce or perhaps eliminate Lindsey's suspension, but realized they couldn't do so because WADA, not Lindsey, initiated the appeal.
By the time CAS ruled, Lindsey has only 5 weeks of suspension remaining. So CAS instead decided to rule that WADA, IAAF and USADA had to pay all of Lindsey's legal expenses, something that CAS rarely does. This isn't mentioned on Lindsey's website, but it is in the CAS Arbitral Award document that CAS will soon release.

While I agree that the rules seem Byzantine and those enforcing them incompetent, I\'m sorry, but she seems rather stupid. Whatever she was told or promised by organizers, to knowingly continue to take a banned drug based on someone\'s word that there wouldn\'t be drug testing and vague promises that things could be resolved by backdoor methods seems less than clever. Anyone not born yesterday should know better than to trust in such vague, undocumented and baseless promises on the part of organizers she was already well aware were incompetent.
Why take such a risk? While I don\'t think she is a drug cheat, I also don\'t have much sympathy for her - she knowingly broke the rules while being well aware her paperwork - yes, not through her own fault - had not gone through. What makes this girl so special that she is above the usual rules and enforcement? She could have prevented this situation by not running the race, or stopping the medication - she chose to do neither, and now she is taking the consequences.
Based on "someone's word"? Um no, based on the word of USADA. She was, as far as she knew NOT breaking the rules. She did the right thing by going to the authority to ask. They screwed up.
She asked what she was supposed to do and they told her. Wrongly.
As Lindsey explained on page 3, she could not stop her medication because she was recovering from a serious throat/lung infection -- which if it spread to her heart could be fatal (myocarditas).
She also explained on page 3 that the Gold Coast Marathon race was her only chance to get a qualifying time to enter the US Olympic Marathon Trials. Lindsey felt she had a chance of placing on the top-3 in that trials race.
Please read her story more carefully before posting misleading statements.
Never refuse to take a test. NEVER.
While there were numerous foul ups, if she had taken the test and had tested positive, then all of this would have come to light and no sanction ever would have been made.
In 2009, there is going to be more flexibility in applying sanctions to allow for cases like this.
However, the agencies have to be strict on the refusal of tests.
