What was he "doing" that was so wrong? How many millions of teens (both minors) have had oral sex and NOT gone to jail. Why should anyone go to jail for this? The most ridiculous part is that because it was oral sex rather than conventional he gets 10 years. If he had conventional sex it's a misdemeanor. It's a bad piece of legislation, plan and simple. This is the type of article you want to print and give to your kids later. Tell them to watch out and don't be stupid, because even the most "innocent" of things can screw your life up. Ask those Duke players... I'm sure none of them thought a little drinkin' and strippin' was going to lead to what they ran into.
It's too bad for this kid. And advice for anyone else out there: Stop vidoetaping yourself doing things of questionable nature!!! The videotape helped the other guys get out of their pickle, but it landed this guy in jail.

He did not have sex with the 15 year old. Had he had sex with her, it would have simply been a misdemeanor. Since GA obviously has some backwards laws, oral sex is viewed as much worse than sex, and he got the book thrown at him. To this day, the girl who gave him the BJ insists that she initiated the BJ, and that he did nothing wrong.
I am not sure how the jury found him guilty, that is really weird.
I know that I received a few of those while in high school, and I am not in jail for 10 years. WTF?
I will also say that this has little to do with the Duke Guys though, as the Duke guys did not actually have sex with the stripper, and the stripper accused them of rape.
This guy wasn't accused of anything, the girl was the one that wanted to do it.
He was 17 years old himself, not 18. Do you realize how many guys would've done the same thing under the same circumstance at 17 years of age?? Pretty much most of them.

the jury is in a tough position. he was in fact guilty. (this is the same reason why his legal appeals won't get him anywhere most likely). it's the prosecutor's job in that situation to exercise discretion. it's also the legislature's job to make sure that outdated laws aren't on the books. and the governor's job to issue pardons when something absurd like this happens.
i really, really, really wish that a guy like mark cuban would run hundreds of single-issue political campaign commercials until those elected officials do their job properly and get this poor guy out of jail.
back to the jury - the article states that the jurors were incensed when told that the sentence would be 10 years. i'm sure that nearly all of them thought he would get little or no jail time. this is a recurring problem in the american criminal justice system. the jury is the "fact-finder" but it usually has little role in sentencing. and in many cases, the jury can't be told about the sentence because it would theoretically harm their ability to be impartial fact-finders.
finally, there is a concept called "jury nullification" in which the jury finds that the technical elements of a crime were committed but nevertheless acquits the defendant. but get this craziness - the defense attorney is not allowed to tell the jury that that is an option. the jurors must know that in advance or just decide to do it on their own.
insane. these types of things would never happen to wealthier people and we all know it. it's so pitiful that our society ignores the unfortunate.

This is a tough one. On the one hand, videotaping yourself smoking pot and engaging in group sexual acts with drunk minors is one of the most idiotic series of decisions I have ever heard of. I know they're teenagers, but come on... that's just stupid on so many levels.
If you put yourself in that kind of position, you can't expect anything good to come out of it. It's the same thing with those Duke lacrosse players... if you hold a team party with a bunch of drunk strippers and then get into a loud fight with them about money... you're not putting yourself in a great position. There's that old Poor Richard saying, "Lie down with dogs, wake up with fleas."
That being said, the sentence is beyond extreme! There's no way that kid should be doing that kind of time. I could see probation, community service... but this is just ridiculous. What makes it even worse is the fact that he has been in PRISON for two years, which gives me NO confidence that he is going to be a better person when he comes out. Probably the opposite... poor kid.
I gotta agree 10 years is just ridiculous. He should've lived in Vermont he would of recieved 90 days.

from a moral point of view, or a legal point of view just about anywhere in the western world besides parts of the american south, he did not commit a crime (well, not the behavior he was convicted of - he did drink underage and i think he was in possession of drugs too).
consensual oral sex between a 15 year old and a 17 year old is not a crime. yet he's been in prison for 2 years.
just flat out insane. and the prosecutor just sits there and smugly says that if the kid would just apologize he'd let him go. who does he think he is? god? it's a young man's life he is playing with.

Best post of the day. Sex isn't something to be advertised. The only way he could have been punished for what he did is if :
a.) The cops see it
b.) Someone reports it
There's no way (a) can happen, so someone must have reported it. Both of them should have been smart enough to realize that, and they should have kept it a secret and not told anyone.
