Most people don't understand the concept of bail. It is to ensure that the defendant returns to court for his/her future court appearances. If a person is so dangerous that their release poses a threat to the public, there are other routes to keep them incarcerated (or released on stringent conditions). But "bail" only addresses the likelihood that they will return to court. If a person has no prior record, the presumption is that no bail is required. With that said, this is just a general outline and every state in the Union has its own particularized and nuanced version of how this plays out. A lot of the "bail reform" legisation was passed because people of color were getting charged with very low level offenses, and then being held on excessive bail. Perhaps in some cases the pendulum has swung too far in the other direction, but the reality is, unless you were in the courtroom listening to the actual bail arguments, you really don't know why someone was released or held. You're just reacting to a headline which was written to get you to click.

U.S. city, county and state courts are run with expectation of close to 95% plea bargaining. Do you know what that means? That's a whole lot of people admitting guilty to a crime, no trial. Do you want to p iss off those arrested? Do you want (50 to 75)% of individuals arrested taking their case to jury trial?
