You can't sue someone if no harm is done. And what you are proposing is an extremely unlikely scenario. A more likely scenario is that you get jail time for assaulting them because you are an insecure bigot.

Where did I ever state anything near hate for anyone? I proposed a simple scenario based on misrepresentation. I never once said anything other than that, and certainly never came near suggesting violence. And bigot? I said I always found Robin Roberts very attractive. So the one statement I made about personal preference is overlooked and I'm about ready to kick some trans rear-end, maybe, could be a bad-ass trans. Really wouldn't need to be that bad-ass.
So, to continue the question, what if the trans person accepted gifts, say totaling several thousand dollars? Is there any scenario where a suit would work? What about the religious side asked about earlier?

I don't see how you can make the argument that a trans person would be doing you harm by 'misrepresentation'. Dating is not some exchange of goods and services, it's just two people hanging out because first and foremost they enjoy eachother's company.
OP is literally stating that he considers dating the purchase of sexual favours from the other person via dinners, drinks and gifts, and should he not want what the other has to offer sexually then he is owed all his time and money back.

Perhaps I could see a case being brought where the trans person has represented themselves as the opposite gender without having the full reassignment surgery and something happened sexually that you were uncomfortable with. Otherwise, I don’t see how there’s a case. I’d be willing to bet there are thousands of guys all over the USA who have slept with a trans woman without knowing it and have no idea.
Personally I think there is no problem if it's a date, meal, cinema, friendship.
If it's sex, then yes it's deception. The law (here) agrees.
For some reason there have been a lot of these cases in the UK, if you google. Most of them got jail time. I think the basic premise was regarding deception. The person thought e.g. they were having sex with a man, when in fact it was a woman using prosthetics. Completely pre-surgery. Not someone who has been living as a man for many years. I don't think people should trick people into having sex, so yes I would have issues with it. They may well have said no if they had been fully informed, so that's the issue. They are consenting to a sexual act they may not be OK with. It is deceptive and premeditated. Not good.
