The capitalism argument is great if there is actually competition or an opportunity for competition. Once monopolies form, it is almost impossible for competition to rise. It would take billions of dollars just to begin to compete. Joe's ISP down the street would be hauled into court by Tame Wirner before he got his first monthly subscriber check even if he could get started. It would not matter if Tame Wirner was right or wrong, they would financially crush Joe's ISP before it ever got a foothold.
To some extent, this is the fault of the rules in the first place. But infrastructure is like that. You can't have 10 sets of power lines, water pipes, phone and cable lines going to your house. Cities, counties, states had to make decisions to provide these services. They also helped fund them, so there is that.
