If the contract was BS then she should not have signed it, but it appears Oiselle came up with some money (and even a bonus that was not part of the contract) when no one else was.
Let's say Oiselle sues Nike. Would it need to prove that Nike suggested she break the contract? Or did Nike make an offer with the condition she break the contract and it was the decision of Tori (and her agent). Seriously, any damages would be meaningless to Nike from a financial perspective. Probably best Oiselle could hope for is to get back the value of the contract and maybe some compensation for losing exposure from USATF (which would not be much).
Tori made a highly unethical decision.
