At the big programs, June is NCAA first round, NCAA second round, and USAs. July can be quite busy with camp season but it is also when coaches take vacation (included in my calculations) and scale down to "only" 35-40 hours per week when they are in the office while scaling up recruiting efforts and getting logistics set for cross. Any time below 40 hours in these weeks that isn't accounted for in the vacation time I incorporated in my analysis is pretty trivial.

Yes, public sector employees, teachers, and coaches are not covered by this law.
The Democrats usually exempt their political allies from the adverse consequences of their policies. The huge numbers of ObamaCare waivers granted to Democrat supporters is one example of this.
There two ways to look at this:
1. If this law helps out lower paid employees so much then why aren't they willing to help out teachers and coaches?
2. If teachers and coaches were exempted because Democrats knew it would result in big layoffs, then they would know that layoffs will occur everywhere the law does apply. Why don't Democrats care about those people?

Ya youre right there is no power there... however the courts have found creative ways of propping up the interstate commerce clause, the power to tax, the power to promote general welfare and all sorts of other living constitution arguments, such that they have gained that power through precedent, and it's not going away. No one is going to win a constitution argument over this in a way that congress is going to do shit about the overreach. Nor will the courts. Nor will a president. It is what it is. Now you have to hope they don't mess up withe the power they've given themselves illegally.

The athletes should work a real job. Many people train at a high level while working a 9-5 job.

As a D1 coach I had no problem doing my job and doing it well without spending more than 40 hours a week on average. Much of the "workload" is self-imposed busy time.
