Yes and the point you're repeatedly trying to make is off value by a factor of 25+. It's not remotely likely that someone could do what you're imputing to this fella's situation. Best of luck to you.

CPA is explaining the rule and is correct. Bean counter is explaining rational thought. Both are correct but CPA is doing through due diligence. It is correct to determine how much prior gifts were made. If you don't do this you are doing a disservice to your client. Built in gain means nothing because a gift is given at FMV as CPA stated. Any big firm makes sure all gift tax returns are given proper due diligence as the IRS is prone to audit.
