Neither of you have it right with regard to Miranda. If a defendant's Miranda rights are violated, then the statements that they gave before being mirandized would be ruled inadmissible as would any evidence derived from those statements (with possible exceptions for evidence that would have been discovered independent of the statements given prior to being Mirandized - although Crim Pro was 20 years ago, so I'm a little rusty there).
At that point, the case would still be allowed to go forward if the prosecution still had enough other evidence to support the charges. It would not be summarily dismissed.
There would never be a mistrial as a result of a failure to Mirandize a defendant. Depending on the timing of appeals on rulings regarding admisssibility of evidence (whether those appeals would be fully processed before the criminal trial or contemporaneously therewith), there may be the possibility of a new trial of evidence that was allowed at trial was subsequently ruled to be inadmissible. Again, I'm a little rusty here, but I think the appeals on this issue would likely be resolved before trial.
The example of a theoretical dismissal I gave was for shoplifting. Throw away your textbooks from 20 years ago. With a crime like this, no statements will be thrown out.
The 5th amendment is the 5th Amendment. It provides the same protection regardless of the crime. I was talking about process, and that works is the way it works.
The idea that a case will get thrown out because of a Miranda violation is simply wrong. A Miranda violation will result in the evidence being surpressed. While that may result in insufficient evidence to continue prosecution, that is a different hung that a dismissal as a result of the Miranda violation itself.
If you don't appreciate that nuance, I suspect that you didn't go to a very good law school.
You both are missing the point. This *case* is now defunct. You can bet your ass that those 3 detectives (Ryan Hite, Tom Buckley & Brad Cecchetti) will most definitely be fired over their disregard for the law and cowboy way of handling business.

WSLS posted the entire Search Warrant by the attorneys at around the 01:00 mark in the video, at 12:52pm. Later that evening, WSLS omitted that portion of the video, and for whatever reason replaced it with the actual site on Craigs Creek Rd where the teen was discovered. >>

This thread has been insane for quite a while now. Lots of random crap totally made up. I'm sure you could narrow the lies down to one or two culprits.
At least we are getting inside info into the inner workings of these high-profile case(s). Who cares which pipes the leaks originated.
I'd imagine at some point they will charge him with Perverting The Course Of Justice and stop the leaks once and for all, depending on how many copper pipes explode in the process.
