From what they've said, it's clear Magness & Goucher talked to USADA several years ago. If they had given the USADA enough to charge Rupp or Salazar with doping, it would have already happened.
If you go to the USADA web site, you can see how often athletes are tested.(If you are lucky -- the athlete history page often does not work, for whatever reason.) For the last several years, Rupp has been the most tested track athlete. He is also one of the most tested of all athletes. Two years ago, only Floyd Mayweather was tested more times than Rupp.
From this, I think two things are clear: 1) the USADA is suspicious of Rupp; but, 2) lacks the evidence to charge him. So for now, all they can do is keep a close eye on him. And from the record, they are doing that with a vengeance. So far, the testing does not seem to have turned up anything.
Unless we get some more compelling evidence from either side, I think the pr war is going to end up where it is now -- a stalemate, with lots of justified suspicions and bad feelings on both sides, but nothing like definitive proof.
In other words, the sniping will continue, but there won't be any real casualties on either side, except the truth.
Oh, yeah, one more thing. With all of this attention on NOP, other runners who are doing will face much less scrutiny. (Just looking at the test numbers over the last few years confirms this. Runners who live in Portland, like Flanagan, get tested more than even known dopers, such as Gatlin. And Jenny Simpson basically gets a free pass, with only four or so tests each year.
