So now there is nothing left but to get those times and medals stripped from his record. And then the bully will humbled. It's coming.

i completely agree that headphone wearers should be DQd but given the considerable discretion of the race officials to enforce the rules as they see fit there would be no issue at all with issuing a final warning about DQ for this offence whilst DQing for the far more serious offence of cheating.

I forgot to say two things in my longer response to the "intelligent troll" earlier.
1) Mike wouldn't be DQd for not having photos of him on the course. He would be DQd for not running the race. The lack of photos is not the cause, it's part of the evidence. Just Like Aaron Hernandez wasn't put in jail because he was brandishing a gun in his own house he was put in jail for killing someone. Brandishing the gun in the house and it being recorded on video is not illegal but it was used as evidence.
2) What was just said above. The waiver the runners signed stipulated that anyone can be DQd for any reason. And just because Mike Rossi would be DQd for cheating does not mean that everyone who wore a headset should also be DQd or even that anyone who cheated would be DQd. It would be up to the discretion of the RD. And I don't think marathon cheaters are a constitutionally protected group so he couldn't exactly file a discrimination case either.
Now only if the LVM RD could comprehend this. And this is where our troller did have a valid point.

Well, no. Not for any reason. Just because it's written in a waiver, and you sign it, doesn't mean that it is legal.
If you'll forgive me for taking it to an absurd level, the RD couldn't DQ a guy because he was Spanish, and the RD hates all Spaniards, and then show him the waiver and claim she is protected.
I'm reminded of a bit of advice a lawyer gave me, many, many years ago: if you sign a paper that has a clause that is illegal, don't worry about it, because the agreement isn't worth the paper you signed it on.
