This is nuts. The driver was determined to be "at fault", Roady had the right of way in the cross walk, he runs her over, and yet "police say there is no information or evidence to indicate that any charges will be placed against Presley" ??? If you run someone over in a well lit cross walk, it's just "oh well, my bad, sorry" ??
There's got to be some charge, right??
But the lesson for others: even if you have the cross signal and are in the cross walk, don't expect to be safe or for anyone to stop for you. Shouldn't be that way, but that's the way it is in most places. In fact you might be less safe if that little white walking man makes you think that no cars will be flying towards you. They usually will be.
He's a fireman and probably has a good relationship with the local cops. I bet he could have hit a pedestrian, called it in as a ht and run, been called on the bogus call and still not have been charged.
I have no idea what happened here. Could be an obvious fault case or just a horrible misalignment of stars. No idea.
However, I would urge everyone... And I tell my kids this all the time...
Don't assume ANYTHING when crossing a street. In fact, assume a crazed fool is driving the next vehicle. Make sure cars see you... Make eye contact.... Have a plan for the unexpected.
Read it again. He was on his way to the hospital to pick up his other two crew members that were on the ambulance, not still at the scene, with the previous call they had just made. He wasn't headed home. Lexington isn't like Rescue Me. Firefighters just don't leave and show up as they want.
If there were no mitigating factors, drunk driving, drugs, etc..., I don't think charges are always brought in an 'accident' like this. It was a simple matter of 'he didn't see her'. Contributing factors are weather and poor visibility.
I've seen people do some stupid stuff behind the wheel and kill someone and get away with no serious charges. Unless some gross negligence is involved (pure stupidity), I'm OK with that.
Word of advice that I was given and that I passed onto my kids.
Turn signals don't turn cars and stop signs don't stop cars.

You're OK with drivers plowing through pedestrians in crosswalks, when they have the right-of-way? I'm not.
Pending any legal pursuits, this may be the last we learn of what happened---a confluence of unfortunate circumstances seems to be the "official" final assessment.

Tragically sad on every level.
Tragic story. Based on that information, specifically "The Christmas tree at nearby Triangle Park" issue, would seem to prompt the attorney for the family to file an action against the city, fire department, etc. The article said there was no active litigation or settlement negotiation evident, which is odd, unless they were specifically waiting on these reports.
