What this tells me for sure is that USADA is a joke.
Basically, if we can't catch you in the act with science, we'll come after you later with hearsay testimony and make your life a living hell. They assumed he was guilty from the get go and found a way to make it stick. Sort of like Bush's WMD "evidence".
The International Cycling Union (UCI) and US Cycling conduct the testing, and monitor their sport. This case comes down to the fact that USADA and WADA do not trust that the UCI and US Cycling are performing their duties legitimately be concealing test results, etc., for its own purposes (similar to the MLB, allegedly).
USADA is exercising its jurisdiction over the results management of the underlying sports federations and sanctioning bodies in cycling.
The various sports federations and sanctioning bodies, USADA, and WADA have all agreed to this overall process under the IOC, World Anti-Doping Code, and UNESCO International Convention against Doping in Sport.
This is all well-established law. The arbitration process and Court of Arbitration for Sport are well established processes for determing the law, and adjudicating disputes.
The sports federation, sanctioning bodies, and athletes are all explicitly and tacitly subject to this process, based on membership and participation.
Cycling has a long-lived reputation as the dirtiest sport, and this case represents a type of "straw that broke broke the camel's back."
"The World Anti-Doping Agency, the organization charged with monitoring international compliance with the code, has determined USADA has results management authority in this case because USADA discovered the alleged anti-doping rule violations," the agency's lawyer, William Bock III, wrote to Sparks on Friday.
Said USADA CEO Travis Tygart: "UCI's attempt to control the outcome through pressuring USA Cycling is tellingly sad and is further evidence why USADA as an independent national anti-doping agency that exists solely to protect clean athletes and the integrity of sport is the proper body to handle the case."
