I would be very suprised if Nike or any other shoe manufacturer for that matter gave you a guarantee that you would remain injury free if you wore their shoes.
You need to satisfy 3 requirements to win your litigation case.
1. Prove that a duty of care exists.
2. Prove that Nike breached this duty.
3. Prove that you were harmed by that breach.
Say for example you wore Nike Shox. Nike markets these shoes as running shoes for serious runners. Say just for the sake of argument that Nike did test studies that showed that their Shox line caused an abnormally high rate of injuries among testers but they kept this quiet because focus group findings told them that the shoes would fly off the shelves.
Here you have a case that Nike knows that they have a dangerous product and they they owe you as their consumer a duty of care to protect you from that product. If they sold you the shoes regardless...either on purpose, recklessly, or out of carelessness...then they have saisifies #2 and have breached the duty of care.
You then have to prove that your injury was cased as a direct result of Nike's faulty product before a court will award you any damages.
I bill $500 an hour...send the check to..... ;-)

It depends, are you too "fat" for our air technology? If you are, then you can not sue. Are you too "ugly" for our stylish uppers? If you are, then you can not sue. Are any of your family members working in our "sweat shops" over seas, I mean, ahem, our "factories" in "north dakota"? If they are, then, remember, Nike has air technology in most shoes, and like a placebo, it helps morons do it higher, faster and longer. (I also considered doing a vaigra spot.)
