long story short... I was recently in a confrontation with an aggressive, irrational meth addict. Without explaining the background, he is well-known to be aggressive and has been increasingly problematic to everyone around him in recent months, and has been making threats which people aren't sure whether to take seriously. Anyway, he didn't hit me during this confrontation, but he attempted to "rough me up" by grabbing my shirt and pushing me repeatedly. I had a collapsible baton concealed in my shirt sleeve, which I had initially planned to use only in a worst-case scenario if he attached me. I warned him repeatedly not to put his hands on me again, but he seemed to take it as a challenge and only became more aggressive, yelling louder and pushing harder. I tried to retreat and he pushed me from behind. At that point I basically snapped and struck him with the baton, hitting his arm. Then I ran like hell got the hell out of there before he had the chance to recover. Afterward I found out that the blow broke his arm. This was about two weeks ago and the police haven't been called yet, but I am still worried that I can be held liable for a felonious assault. My defense would be that the guy first committed battery against me by pushing me repeatedly, and that he freaked me out and caused me to retaliate. I have read the laws in my state and htey are kind of ambiguous, so I don't even know what degree of assault I would be charged with or whether the circumstances are mitigating. Any insights?
