Did you read the article? He hasn't been "charged" with anything. No criminal complaint, no criminal investigation, just a 300k fishing expedition by a crazy woman. She's claiming a pretty large conspiracy where people have broken into her house to erase data off her computer that's evidence? Come on, this is almost laughable to even be reported on in the press.
Wait a minute, she doesn't file a police complaint and then waits a year to file civil charges? Smells. $$$$$
Broads do this crap all the time. I hope he stands up to her. sometimes the athlete just pays with a written guarentee that she can never talk about it or be sued herself. Thats is basically extortion. Broads have been using their vaginas as weapons for centuries. Just look at Title IX.

Ben Roethlisberger is my least favorite athlete, but it seems like the facts are mostly on his side.
That being said, her story should still be heard otherwise if there were an athlete who liked to sexually assault others, he would just go about raping hotel workers who seemed kind of floozy because he would know that it would never come to trial.

Just because a women may "seem kind of floozy" doesn't mean they aren't going to call the police if they get raped.
Civil suit is the correct move; Ben has big bucks so a top notch lawyer team and prosecutors really not that keen on the evidence and the biggie: Roethlisberger does not have to testify. In a civil suit she can get a top lawyer on contingency for the publicity and Ben would have to testify. She is no dope about her options.

Maybe it's different from state to state ; but i ask, how does a prosecutor come into play in a civil suit that had no attempt at criminal prosecution ?

There are no prosecutors in civil suits. Each party brings their own attorneys. Prosecutors are state or federal employees and only work criminal cases. The accuser is the state or federal government. The defendant in a criminal case hires his own attorney or is provided with a public defender if he/she cannot afford an attorney. There are no public defenders for civil suits. There is no jail time for civil suits. Civil courts just shift money around according to how the judge apportions blame, mainly.

lets face it, if you are a prominent athletic, its rare that you will be busted. We treat women (Kobe)in our society worse than dogs (Vick).
