If the track was measured with the rail inside the inner lane, then would certainly legitimatize the track - whether a rail or cones were placed inside.
From what I saw of the videos of 2007 and 2008, which are still up on flotrack.com, the rail was on the inner lane as normally found on most tracks.
Notre Dame is nothing if not inconsistent.
