Borrowed from someone else: "I know it looks like a duck, walks like a duck & quacks like a duck, and defendant submits an affidavit it's a duck, and plaintiff does not dispute it's a duck, but I say there is a factual dispute whether it's a duck." Judge Aileen Cannon

The SCOTUS has shown you no longer have an independent judiciary. Cannon is a Trump appointee. So she does what he wants.
The 2021 assertion to the National Archives vastly misrepresented the scale and variety of documents, including classified records, later recovered from Trump’s property.
Judge Cannon's rulings are increasingly bizarre. This Order on the Special Master needlessly complicates and delays things for no real reason. This is a search warrant, FFS. Can you imagine if every search warrant in the country had to go through all these procedures?
I think she is trying to be tough on the government in this high profile case. But the time to do that is way down the road at trial, in the event we ever get there. Right now she is just jamming things up and delaying proceedings. Halting a criminal investigation because the defendant claims he's innocent?!?! No other defendant in the US will ever get this kind of relief on a search warrant -- although tens of thousands of defense lawyers will surely be trying to going forward.
LMAO! The special Master that Trump picked and the right wing rejoiced over is asking Trump questions and setting aggressive deadlines. Trump has said multiple times that these were declassified documents. So when asked by the Special Master about whether they were or not, now Trump's legal team says "no comment".
The court of law is no place for a liar like Trump!
Trump lawyers want to hold on to the docs, just in case they need them to defend Trump in a criminal trial later. Also in a very quantum mechanics kinda way they will not say whether or not the classified docs were declassified by their client. Again, they don't want to say because that might come up in a criminal trial. Who's to say, whether or not those documents were ever really classified? Follow the lawyer's hands, your eyes are getting sleepy...
Judge Raymond Dearie conducted his first hearing as “special master” over the documents the FBI removed from Mar-a-Lago on Tuesday, and it was not a good day for Donald Trump’s legal team. Dearie not only insisted that the wh...

Unless they wish to state all of the documents were de-classified, Trump's team can't say any specific documents were de-classified because that would carry the legal implication that others remained classified. A big problem for the Trump team in this caper.
The SM is all a delaying tactic which Trump has used legally for many years....learned from his father.
Yes delaying tactic -- but it shouldn't have been allowed wrt the classified docs. As the SM Dearie pointed out, he (and the judge) are not qualified to determine what is classified and what isn't. And since trump lawyers refuse to state whether or not they are even trying to claim that trump declassified anything, the court is forced to accept that the documents are classified. 'Prima facie' - they appear to be classified, NARA and DOJ are saying they are classified.
The U.S. Court of Appeals for the 11th Circuit disagreed with Trump that the classified documents seized on Aug. 8 might be his property, rather than the government’s.
Two of the judges are Trump appointees, delicious.
The best part about this ruling is Trump brought this smackdown on himself. He brought this lawsuit without even being indicted first. The government case has now been green-lighted by the 11th circuit, and DOJ has been put in a position where an indictment is the only acceptable outcome. Prior to this litigation, I would have put the odds of criminal charges against Trump at less than 25%.
Trump is playing that 4D tic-tac-toe. A true master strategist, like Putin.
This is all an act. The SM is acting tough just to make himself look legit before he dismisses all charges as he has benn payed to do. Yes, Trump is above the law and will stay that way as long as the people on both sides are this gullible.
