Anyway you do it to get the results is legitimate. You could look at the way Merci Chelangat raced in the indoor championships in a similar way. She would surge, then go slow. She seemed to be trying to get the other runners out of running "their" race, and run hers instead. Perfectly legit.
They all basically jogged for the first 3200, and then a few of the top runners took off.

I like the bike races on the track where they try to go as slow as possible. I'm always wondering if one of them will fall over.
