Since Seb Coe did not ban Nike Vaporfly in 2016, has he lost the ability to ban ANY shoe in the future?
If some inventive shoe designer comes up with a shoe with a powerful sling shot effect, is this not an improvement on Nike Vaporfly? Even if 50 'thonners are breaking the 2 hour barrier.
In other words, has the horse bolted the barn and cannot now be reigned in, in the field of super shoe design?
Could a non-Nike shoe designer now legally and overwhelmingly argue that since Coe let Nike get away with Vaporfly design, any shoe after that is free from design limitations, particularly IF IT IS MADE AVAILABLE TO ALL.
Are we now in the Wild West of shoe design?
