I ran one cross-country and one track race throughout my four years of undergrad. I didn't run due to injury.

but the person who could help you figure it out real quick is the coach of the school you are going to attend (that is, if they want to roster you as a grad student).
There is typically some grey area, so the best thing to do is contact the coach with your previous college transcripts and NCAA ID in hand, so their compliance office can check you out.

Ignoring COVID changes you have 1 full year of eligibility left unless you also received medical hardships, in which case you may have 2 years left.
Counting COVID you probably have 2 years either way.

There is a possibility that while you have eligibility, the coach is not interested in rostering you.
Since grad students are at the end of their career, the expectation would be scoring at conference, or at least top 5 in XC. Otherwise, most DI coaches would not be interested.

You are presumably assuming that he went straight from undergrad into grad school, but this must be clarified before you can say that there is no question that he has remaining eligibility, right?

Another avenue for this prospective athlete would be to contact his/her school-to-be's compliance officer--s/he should be able to help.
Because I started Undergrad in 2015, my 5-year clock is done.
Would an injury petition do anything?
No. You chose to skip a bunch of years.
If the school is buy, then you have at least 10 more years of eligibility.
