People who file cases like that don't want it to get to discovery. Then he has to turn over bar receipts, liquor store receipts, and worst of all - get deposed. And the Atlantic will depose all the witnesses they've already talked to when they investigated the story, including all the FBI employees who relayed stories about Patel's pathetic inability to handle liquor.
Patel doesn't want any of that stuff getting into court records. He wants the media splash from filing the case and acting like he's the outraged victim, then he wants a quick settlement, or even getting the case dismissed so he can blame the corrupt judge, etc. Those are Patel's optimal outcomes.
