Title is misleading, not just because we don't know that the jury is all white.
Most of those 500 were eliminated through questionnaires and excuses from service.
Only about 40 made the cut to voir dire.
3 of those were black, all female.
Each was an educator, so they were dismissed.
There was no systematic attempt to keep blacks off the jury.
Right. A pool of over 500 people, pared down to 12 jurors and 6 alternatives. Not one of them black. Just the way it worked out
Frisco is roughly 9% black. In a perfect system, one would expect 1.6 of 18 to be black (although blacks are more likely to have a prior felony, which is a disqualifier for jury duty, so it might be slightly less). Having no black jurors is not a huge statistical anomaly. Between a quarter and a third of Frisco is Asian. There are likely a number of Asians on the jury. There are likely 1-2 Hispanics on the jury and the remainder are likely white (Frisco is about 45% white). In Texas, each side gets 10 peremptory challenges where they can dismiss a juror without cause. It is an imperfect system (just as it was for Trump’s trials in New York and Jan 6 trials in Washington DC where 90% of potential jurors were Democrats).
By and large, Prosecutors are more concerned with winning than justice, so they will use their peremptory challenges to exclude those they anticipate are an impediment to victory (prejudices do play a role. In this case, prosecutors would look to excuse black jurors. In Trump’s and Jan 6 cases, prosecutors would cross reference voter registration records to strike potential Republican jurors). A better system would be to make jury selection blind, where attorneys are not made aware of the gender, color or name of the potential jurors.
