Federal courts all over the country are recognizing that Trumps DOJ is not deserving of the presumption of regularity typically given to the government. They see that they are lying, liars that lie a lot.

It looks like the prosecution was in an enormous rush to beat the statute of limitations deadline, and they realized they could never get a warrant, review seized documents, draft an Indictment and present to a grand jury in anywhere near the amount of time they had left. So they opened up closed files from search warrants unrelated to the Indictment -- some of which appear to have been unlawfully executed to begin with and were also never screened for attorney-client privilege -- and then presented those documents to a newly hired and inexperienced insurance lawyer, who had never even looked at a criminal matter in her life, to get the Indictment. Highly suspect behavior at best, and maybe a lot worse.
The part that interests me is at pages 17-18 regarding what many believed was just Houlihan's inexperienced confusion in presenting the "True Bill" and the "No Billed" to the Magistrate on the day of the Indictment. I think Judge Fitzpatrick is saying Houlihan may have drafted a fake True Bill and/or fake No Bill AFTER the grand jury proceeding was done and then lied about it to BOTH Judges (Fitzpatrick and the original Magistrate Judge). Page 18: "If this procedure did not take place, then the Court is in uncharted legal territory in that the indictment returned in open court was not the same charging document presented to and deliberated upon by the grand jury. Either way, this unusual series of events, still not fully explained by the prosecutor’s declaration, calls into question the presumption of regularity . . ."
