i do agree that the majors - particularly NFL - is likely the worse.

I personally think that would be the holy grail to make them do WADA. Get about $100 million from soccer, nfl, mlb etc and then we'd really catch some people.

I thought there was a real T&F athlete named Lancey Poo who I'd never heard of who had failed a drug test. Maybe one of those sketchy-looking female 400m hurdlers, I dunno.

Lance is obviously dirty, but I wouldn't be surprised if the French reporter was totally making up the whole source thing. It would be almost impossible to prove and the French tend to hate Lance, but we'll see I guess...

That one should be able to sue for defamation even if you are:

1. A public figure(LA) who actively sought the limelight

and

2. There are five to ten sworn eyewitnesses(LA' teammates) prepared to testify to the truthfulness of those negative allegations(conspiracy re: doping).

But, the legal theories of Lance supporters are actually these:

The USADA has been claiming for sometine that they have these.

They have never produced these alleged postive samples belonging to Lance.

Actually this is a new claim. they are claiming recent retests of some of Lance's samples with newer testing methods have revealed positives. This is beyond the "passport samples consistent with manipulation" in the '09-'10 tours. They have not released what the positive is for or what year it is from but we know USADA had physical possession of at least 38 samples from Armstrong that they could retest.

I have seen speculation that he tested positive for CERA from the '04-'05 time period. I have no ide if that is true or not but it would be big news, since CERA was not available legally on the market until the '07-'08 time period, which would mean its acquisition involved acquiring and using medicaiton which was in the investigation stage and subject to a lot of strict legal controls.

There is really nothing to do about these samples but wait until the whole information comes out.

Horrible example and you know it. People aren't hating on other people for speeding. Lots of things that are illegal are just plain stupid.

Again, even if he admitted it it wouldn't change a damn thing to people who like or hate him. Chances are he would still say he didn't do anything wrong and again people wouldn't be able to prove a damn thing. At least we might get to see some actual test results. That would be novel.

What samples could they have gotten from AFLD? Does AFLD hold TdF samples from previous tours?

Yes, that is the only possible theory that I can see that wouldn't be laughed out of court but there are still very serious problems with that. One, Lance is a public figure. As such he has to prove that posters acted with malice towards him. That is a high bar. The second problem is that truth is an absolute defense to libel. As such, quite a lot of the statements about Lance would be quite defensible. For instance, calling Armstrong a drug cheat it totally fair and acceptable legally, since he has been convicted by USADA of cheating with drugs.

There are indeed quite a few posters who are not stating things as facts. In this thread people are reporting what was in a French news report. I reported that there is speculation that it was CERA from the 2004 era. I don't know if that is fact and have not reported it that way.

Finally, there is the expense vs. recovery involved. Forum providers like Letsrun.com are generally exempt from being held liable for statements written by the users. Lance would have to sue the users individually, first making letsrun divulge their identifying information. Then he would have to prove that any false statements made harmed him--presumably this harm would have to be in addition to the harm that Mr. Armstrong caused himself by being a drug cheat (note: already established as fact). Then he would have to recover those damages.

So, I guess it is possible that he could sue, doubtful that he could win and extraordinarily doubtful that it would be worth his time and money.
