If she can run 10.6 again, without failing a test in the future, I'll buy that she is clean. If she struggles to break 11, she cheated.

If a 30+ year old mother runs 10.6 again. She's not only clean (assuming no negative tests) but the greatest female sprinter ever produced by the human species.

She doesn't have a case and would waste her money pursuing one against anybody who talked about information published in a newspaper. She also wouldn't have a case against the media, which includes Letsrun.com. There are plenty of thick and dusty volumes of U.S. Supreme Court decisions that address these points.
Thanks for setting me straight on the law. You seem to know what you're talking about.
Something must change, though. The damage caused by these leaks, in terms of both money and reputation, is very real.

How strong a case does she have against the USADA/WADA?
Please!!! I don't care if she's purple and had two heads. With the volumes of evidence against her I think it is perfectly reasonable for people to conclude that she's dirty. Do you also feel that Regina Jacobs was railroaded because she was a black female? I think that I speak for most people on this site in saying that we don't care what color, sex, etc. the drug cheats are, but rather that we get them out of our sport!
Agree, she has suffered damage. And to that end, I would spend some time researching the viability of actions to obtain recourse for these damages based on business torts and breach of contract issues with the sponsors who dropped her and meet promoters who excluded her based on rumor, speculation, leaks, and innuendo. (Note: This is where and why a Union would be very helpful to pros.)
I'm not saying she didn't and/or hasn't cheated. She just hasn't been caught cheating (proven by USDA/WADA standards). Afterall, she is fast. And again, the so-called evidence against her thus far has been weak, weaker, weakest.
of coarse she has suffered. who's fault is that? mine? ESPN? ABC? no, it's of her own doing.
so the lesson is; if you are a world class athlete, stay away from people selling and doing performance enhancing drugs. she's college educated and well versed in track and field. she cant play dumb.
if you people are that dumb to stand by her, you deserve what your sport is getting. but what a GOD DAMN shame!
No case against USADA. The U.S. government and its agencies (USADA) are generally immune from suit.
Agents of the government are qualifiedly immune. So, if a government agent acts outrageously and without the sanction of the government, e.g., commits a murder, embezzles money, the government agent could be sued, but not the government. The government would assert its (absolute) immunity in defense if sued, and the agent would assert his/her (qualified) immunity if sued. The court would very likely grant a summary judgment motion of the government, but deny one of the agent in these circumstances.
WADA's an international body. Although the same analysis applies. Generally, bodies politic, including international bodies, are immune from suit.
Here's a quote from my post yesterday.
'Note: Her circumstances boil down to personal responsibility. She chose to associate with nefarious characters and her reputation (and Prada pocket book) has suffered as a result. Had she sought my counsel I'd tell her, lose the losers, you have too much to lose and nothing to gain.'
However, just because she hung/hangs with nefarious types (shady characters) doesn't mean meet promoters are justified in excluding her and sponsors are justified in breaching their contract with her. So, as I mentioned in response to Dweedle's inquiry, she obviously has suffered damages. You have acknowledged this much. Yes, she's to blame, in part, for hanging with the wrong crowd. But, when XYZ sponsor entered into a contract with her, XYZ likely did its due diligence and learned about this wrong crowd and executed the contract nonetheless. Now because XYZ sponsor has stopped performing its obligations under the contract and terminated it based on rumor, speculation, conjecture, and innuendo, Marion very well may have recourse against XYZ sponsor. You see, XYZ sponsor's basis for terminating the contract was not sound. An action against the meet promoters for taking actions against her which interfered with her business interests/advantages (money) is not as strong because as private entities, like restaurants, they have the right to refuse service/entry into a meet. Both actions merit some research, especially the proposed action against XYZ sponsor. Last example, it's as if KRB sponsor terminated Allen Iverson's contract simply because it decided, arbitrarily, it didn't like his tatoos anymore, or XYZ sponsor terminated Lance Armstrong's contract with it because of rumor, speculation, innuendo, and conjecture about his alleged use of performance enhancing drugs.
She should Sue...Lets Run...They sure know how to hirt some people...THe reason I post here is because I like reading the stuff they come up with...I just hope they stick to this and not go into politics....As a Black Man I Would Finally leave this Country...
why hasn't she sue ANGEL MEMO HEREDIA? BECAUSE SHE KNOWS IT IS F***ING TRUTH!!!!!!

I second that!
Remember unlike Floyd Landis or Lance Armstrong Marion's skin color isn't the same like most of the individuals on this site or the founders of this site. On this site people of color will always be found guilty before the facts are completely out.
God forbid if Goucher, Webb, or our 400M Gold Medalist runner were to have a bad A and/or B sample. Would we have the same witch hunt on this site? We all know the answer to that question (See difference with Landis/Armstrong postings from individuals who are not D. Pound or the French Media)
Because Goucher,Webb, and Wariner have all been caught cheating before? Is that why that was a good analogy?

How much money do you think athletes spend on cheating? How much do you think the goverment spends on catching them? Who do you think wants to be ahead of the other more?
I know many kids that do stuff at my college and still pass their drug tests...
