1/ if the Fed’s don’t indict trump on this, they will set a precedent that they really don’t indict people for mishandling docs. Would make future prosecutions difficult. So they might need to indict.
2/ if trump let MAL workers near the documents then he is guilty of letting non-approved people near classified information.
Apparently there are surveillance tapes showing people going in and out of the room. Unless those people were all government employees with the appropriate clearance, then he did let unauthorized people have access.
Yes, but we don't know if what was unsealed is authentic or not. The FBI could have hacked the PACER court system and loaded up unsealed fake documents.
Pending that determination, the allegedly unsealed documents reveal the following:
The classified documents (the 15 boxes) returned to the government on 1/18/22 contained National Defense Information (NDI)
The NARA referral to the DOJ was on 2/9/22
The affidavit says there is cause to believe there is evidence of obstruction in addition to evidence of additional NDI documents at the Trump compound
There is evidence that Giuliani was drunk when he sent the midnight faxes to the DOJ
Some stuff about documents being confidential or something
Trump said he returned the 15 boxes "to ensure the preservation of my legacy"
Trump originally informed the DOJ in December 2021 that there were only 12 boxes and the DOJ could swing by and collect them if they wanted, as he was now done going through them.
14 of the 15 boxes actually returned to the government had classified documents in them. There was a boatload of classified stuff in there ("184 unique documents bearing classification markings, including 67 documents marked as CONFIDENTIAL, 92 documents marked as SECRET, and 25 documents marked as TOP SECRET"). A lot of this stuff is NDI, HCS, FISA, ORCON, NOFORN, SI, DINGDONG, and other top secret spook stuff.
[REDACTED BY MODERATOR]
Trump's lawyer doesn't appear to have started claiming that Trump declassified all this stuff until May 25, 2022 (see Exhibit 1)
The claim that Trump declassified it all when he left the White House seems to be the primary defense Trump has to whatever the hell he was doing with all this stuff
In response to a defense Trump was asserting, the DOJ told Trump on June 8, 2022 that his compound, including his personal bathroom, were NOT authorized places for the storage of NDI, TS/SCI or other classified information.
The affidavit states there is probable cause to believe classified documents were unsecured in multiple locations at the Trump compound.
Trump's lawyer, at least as of May 25, 2002 is Evan Corcoran. He appears to be mentally handicapped.
Trump argued to the DOJ on May 25, 2022 that he is exempt from 18 USC 1924 which felonizes unauthorized removal of classified information from government security because he was never an officer or employee of the United States. See Exhibit 1.
The originally sealing and the redactions are necessary because "Premature disclosure of the contents of this affidavit and related documents may have a significant and negative impact on the continuing investigation and may severely jeopardize its effectiveness by allowing criminal parties an opportunity to flee, destroy evidence (stored electronically and otherwise), change patterns of behavior, and notify criminal confederates."
There is absolutely at least one rat at the Trump compound: " must remain under seal in order to protect the safety of multiple civilian witnesses whose information was included throughout the affidavitand contributed to the finding of probable cause"
This goddam affidavit is redacted to all goddam hell.
From the affidavit - FBI review of 15 boxes transferred to National Archives contained 184 docs with classified markings: — 67 Confidential — 92 Secret — 25 Top Secret — additional docs with HCS (human Intel), ORCON (originator controlled), NOFORN (only US citizens), SI (special Intel), FISA.
Jaw-dropping. The ORCON stuff is really bad because that is well above a TS/SCI classification.
Example of ORCON could be: DOD related - description of troop strength, troop movements, etc; CIA - Who/where spies are; who/where their contacts are.
And this is what was handed over in June, not what was retrieved from the search in August.

Wow it's like 'but her emails' except actually serious
Who among us hasn't stored a few dozen boxes of highly classified documents for 1.5yrs in an unlocked storage room at the hotel (ie public space) where we live?
We need a law, Gary Disco. A law that bans all redactions in government filings. There is NOTHING in the US Constitution authorizing agents of the government to hide information from law-abiding, god-fearing US citizens. Whatever happened to freedom and transparencism?

Wow, if I were back in the Marines and I was caught just one document from this cache of documents, I would probably be buried in a cell in Leavenworth, AT MINIMUM. And here Trump had FIFTEEN boxes of sensitive information. Who's Trump selling our secrets to?
