The letter discloses that, despite returning the documents to the federal government, Trump was demanding that the documents could NOT be reviewed by certain agencies in the federal government -- specifically the FBI and Intelligence agencies -- and that NARA essentially keep them secret.
That is a very suspicious demand by Trump. In any case, the letter discloses that somewhat late in the game, Trump was demanding the FBI and Intelligence agencies be barred from viewing the documents while Trump "ascertain[ed] whether any specific document is subject to privilege." Given that NARA had already granted Trump two extensions to do that very ascertaining and that determination of the damage resulting from Trump's handling and disclosure of the classified documents was of significant urgency to the country, NARA asked Biden if he would waive executive privilege over the documents so that the FBI and Intelligence agencies could review them. Keep in mind that these are documents that (1) Trump returned, (2) Trump knew the contents of, (3) are classified, and (4) are already in the possession of an agency in the federal government.
Having been informed that a former president had NEVER asserted privilege AGAINST a current president (because its as demented an idea as it sounds), Biden said he would defer to NARA's judgment as to whether executive privilege was appropriate.
