Here are five reasons why Trump might never be sentenced: Reason #1: Supreme Court gave Trump a potential lifeline The Supreme Court's July 1 presidential immunity ruling in Trump's federal election interference case included a section that could negate the New York convictions. Five of the six Republican-appointed justices – all but Justice Amy Coney Barrett – said a jury in a criminal case against a former president can't hear various forms of evidence about official presidential actions. Trump has since argued that, even if the hush money payment to Stormy Daniels and the falsified business records weren't official presidential acts, some of the evidence presented to secure both the indictment and his convictions ran afoul of the Supreme Court's ruling. For instance, Trump is objecting to testimony from his former White House communications director, Hope Hicks, about events while he was president. Even if Trump fails to persuade Merchan, he could ask for an appeals court to review Merchan's ruling before any sentencing takes place. Mitchell Epner, a New York litigator and former New Jersey federal prosecutor, said it's "overwhelmingly likely" that the Nov. 26 sentencing date would be wiped off the calendar based on the immunity issue, even if Judge Merchan rules against Trump. He said the Supreme Court's ruling will likely give both Merchan and an appeals court pause about going forward with sentencing before an appeal plays out. And Trump can point to other types of cases, such as cases against police officers, where appeals on immunity issues are typically allowed to play out before trial. Robert McWhirter, who ran for the Democratic nomination for Arizona attorney general in 2022 and has written a book on the U.S. Constitution, wasn't so sure. Under the standard New York criminal procedure rules, defendants must file their appeals within 30 days after their sentencing. "I would imagine that there has to be a final sentencing," he said. Reason #2: Political firestorm Sentencing Trump now that he's president-elect could also create a political firestorm. That may not sound like a legal argument, but it's still context Merchan and appeals courts will likely consider, Bederow said. "I do think that any judge can't ignore the 800-pound gorilla in the room, which is this guy was just resoundingly voted to be the next president," Bederow said. "If (Merchan) were to sentence him, this country is going to get torn apart even further at the seams." Reason #3: Legal roadblocks based on election Trump's election victory gives him new legal arguments for fighting the sentencing. The Supreme Court's presidential immunity ruling voiced concerns about court proceedings interfering with the presidency. The court said a president can't be prosecuted for official acts unless doing so "would pose no 'dangers of intrusion on the authority and functions of the Executive Branch.'" Justice Department policy also cautions against prosecuting a sitting president, although it isn't binding on a New York state court. Trump could argue similar concerns apply to a state court sentencing a president-elect or imposing a sentence that would extend past his Jan. 20 presidential inauguration. The legal idea is that, under the U.S. constitutional system, power is divided between the national government and states, and states can't intrude beyond their sphere. Legal experts disagree over whether concerns about state court overreach would only come into play after Trump is inaugurated, or whether Merchan or an appeals court would also entertain them at an earlier juncture. Reason #4: A new trial could face new issues If Trump gets his convictions thrown out and is shielded from prosecution during his next presidency, Manhattan prosecutors could theoretically pursue a re-trial afterwards. But at that point, Trump could say retrying him violates his constitutional due process rights because evidence and testimony have aged. "When defendants have that long of a gap between the first trial and the second trial, they will often argue that they can't be put on trial fairly four years later because witnesses' memories will have faded, some people may have died," Epner said. Reason #5: Trump will get older If Trump's convictions stand the test of time but he still faces sentencing years from now, his age could also weigh in his favor. In an interview before Trump's election victory, Catherine Christian, a former Manhattan prosecutor, told USA TODAY that even Trump's current age would work to his benefit in a sentencing proceeding. "It will mess with his brand, but the man is 78 years old, and for someone who's 78 who has no (prior) criminal convictions, the court will look at that," Christian said. Trump would be 82 at the end of his upcoming four-year term. "Even in cases where somebody became a fugitive, at a certain age, they're just not going to be punished, and Trump would be the furthest thing from a fugitive," Epner said. It all adds up to a significant boon for the soon-to-be repeat president.
It is very strange to see Americans celebrating a conman and criminal never facing accountability. They aren't celebrating his innocence as found in a court by a jury of his peers. They are celebrating that he sidestepped justice. That he would never face any accountability like any other US citizen.
They would do this celebration for no other politician or even their neighbor of friend. But Trump is beloved to them. He changed them and corrupted their standards. They don't see it. But we see it.
The Truth remains the Truth. Even if the majority believe the lie.
Correct. Although I agree with those who say that Trump REVEALED America more than he actually changed it.

That is a good point
The past 8 years have taught us that it is wrong to think that all Americans share the same noblest principles and ideals. The Democrats said over and over that “this is not who we are.”
The Dems have announced Gallego has won the Senate with only 88% of the vote counted. It is not possible for Lake to be so far behind Trump. She follows his policys to a T. It has too be cheating, no other way to explain it. Lake has shown how corrupt the system is in AZ. Trump is to big to rig in 2024, but there has to be a big investigation of how in the world Lake can have lost. No reason at all for there not to be a 1 to 1 corrspondance of Trump and Lake.
That said, AZ is perhaps the state with the most active results-manipulation GOPers, so it's still really possible for Lake to pull off the "win"--or at least to keep Gallego from being named the winner. I honestly don't expect the contest to be settled before Thanksgiving.

Lake is not a good candidate. She was a bad choice for the gubernatorial election and a bad choice for the senate. Arizona republicans needs to encourage her to never run for any elected office again.
Here are some things that I needed to learn this election cycle.
1. Trumpers love the lie. It is purposeless to fact check a Trumper because they get off on the lie and embrace it. Like Trump, the trumper can't be shamed with a lie.
If a lie is no longer useful to the right it gets discarded. Election fraud, migrant caravans, immigrant invasion raping and killing. All these fake crisis lies will cease being reported by right wing ecosphere. Right wingers are now saying publicly, "You're damn right Project 2025 is Trump's plan". Even though they claimed it was pure BS and Trump had nothing to do with it. None of the lying is a disqualifier to them.
2. Trumpers want a fascist dictator. Just as long as it is the twice impeached, rapist, pedophile, racist, conman, business and charity fraudster that is their dictator. Anyone else, they would have a big problem with being a fascist dictator. Just this guy gives them the feels they need to toss the country away.
I'm not so sure about the notion that these folks "would have a big problem with (someone else) being a fascist dictator." These folks love Putin. They love Orban. They love the idea of authoritarianism. It is the best way to stomp out the real problems in this country - like some men wearing dresses.

Says the folks who want to suppress free speech, cancil opposing veiwpoints, censor people on the internet, use the judicial system to lock up opposing political opponents. ....

Very few (<1%) "love Putin." However many of us like Orban because he reduced illegal immigration. We also like Bukele because he went hard against the gangs and reduced crime by over 90%.
We don't spend every waking hour thinking about how to spend hundreds of billions of our tax dollars to stick it to Putin (and largely fail), but that's because we're indifferent towards Putin, which is not the same as liking him.
What fraction of REPUBLICAN election officials in all of those states would staye that their election system is significantly flawed or corrupt? Less than 1%? Zero?
And what’s the tally of substantiated meaningful election fraud claims in the FOUR YEARS since 2020? Zero? Yes.
The biggest liar in US history told you to believe it. And you did. Incredible.
And then you voted for him again.
AND decided, apparently, that there was ONLY cheating in states he lost. Beyond incredible.
Here are some things that I needed to learn this election cycle.
1. Sheep Harris followers love the lie. It is purposeless to fact check a sissy sheep Harris follower because they get off on the lie and embrace it. Like Biden, the Bidnettes can't be shamed with a lie.
If a lie is no longer useful to the left it gets discarded. Letting 10 million cross the border illegally, against fracking, for fracking, against the wall, for the wall. All these fake crisis lies will cease being reported by left wing ecosphere. Left wingers are now saying publicly, "You're damn Harris lied and stunk as a candidate". Even though they claimed she stunk it hand nothing to do with the loss. None of the lying is a disqualifier to them.
2. Sissy Harris followers with no brains are crying after their bigly loss. Anyone else, they would have a big problem with being a lying left winger who won't answer one question with honesty. Just this gal gives them the feels they need to toss the country away. But thank God she lost.
fixed all of your liberal errors. you're welcome friend
Scary Lake is a political train wreck, lying grifter.
And Trumpism and the big lie does not scale to others. It only works for Trump for some reason.
She is a big lie champion.
we are also seeing in swing states that people voted for Trump and skipped the down ballot choices because they didn’t care.
You seem upset. Harrisism is done, the lying left winger is out of the picture. The "if you don't vote for me you are a this and that" is gone out the door. Screwing up this great country. Cry harder spanky.

one family, eh? and yours. so that's quite a poll sampling you've provided. congrats

So then, sucks to be you as you've got 4 years of living miserably in what will be great times. Wipe your tears and head back to your basement.
