As an experienced prosecutor, Holder already thinks the probability of getting a conviction is high, else he would not have gone this route. Politically, the move simultaneously satisfies all constituencies save die-hard right wingers. Those who want vengeance will be happy with a prosecution, those who want exposure of war crimes (yours truly) will get a lot of crap put on the record, and those who want the US to actually follow its own constitution will get legitimate by-the-book trials.
The only people upset are those who fear exposure of war crimes or an end to the public hysteria about terrorists. The possibility of acquittals or exposure of state secrets are canards, nothing more than talking points meant as smokescreens.
