Cutting someone for performance issues is perfectly acceptable especially if they have had multiple seasons to compete and have never shown any ability to help the team during those seasons. I know a very prestige DI soccer program that will cut people who have good behavior if the coach thinks that they will never be competitive and can't adjust to the college game.

It describes the lawsuit and tells one side of the story. Now obviously his lawyers are trying to make the coach look bad, but if any of what is said in that lawsuit is true I agree with him.
The coach told the players that if they had played in a varsity event in the 2007-2008 season they would not have to play in his "qualifier". Well Guiliani had played in two varsity events, but the coach told him that he was still to play the qualifier. The ONLY varsity player to have to do this.
There are many other examples outlined in the lawsuit. Now again this is ONE side, but if you take the time to read it you might at least think twice about throwing this kid under the bus.

I graduated from Duke and wish it well .I therefore lift my curse uttered when I quit the track team many years ago.This Guliani thing needs to be settled and the lacrosse players should dismiss their case against Duke.

hypothetically - you are top distance runner on COLLEGE team but you tell the coach you will only run one event per meet.With the consent of the AD ,he THROWS YOU OFF THE TEAM - you are not on an athletic scholarship and are paying 40 k a year to go to this college.IF you sue for reinststatement do you win?
