The problem is that when one state bans an online activity, it can enforce its law against website operators all over the country as long as someone in the restricting state uses the website for the locally illegal purpose.
This has happened with online gambling. One state outlaws it, has their investigators use gambling websties, and then starts issuing arrest warrants for people in other states who operate those websites.

Even if the Kentucky law is unconstitutiuonal, it will take a long time for the legal process to work that out. In the meantime, Kentucky can cause all sorts of problems for everyone.
