In hindsight perhaps Gerber would have been better off filing a complaint later. Remember, Bellingham Sam fled a crime scene, so the cop had 2...soon to be 3 potential perps he was dealing with. Let's get back to the REAL issue here that is conveniently glossed over - when is it okay to be in a womens restroom (not Gerber, but Bellingham Sam).
