You don't just get checks in situations like this. You come to an agreement, one side pays and the other says they are done pursuing the matter. If you got a check, you signed something saying that the check ends the matter. So, you're done.

Look up the rules on voluntary withdraw by a lawyer. In a lot of jurisdictions, a lawyer can't just withdraw from your case leaving you high and dry. Doing so might subject him to professional discipline and some legal problems of his own.

Like this. Something doesn't add up. You either signed something or the lawyer is really bad.

Get another lawyer. The personal injury crowd of attorneys is big. If they say the other attorney settled without your involvement then find a lawyer that sues lawyers for malpractice. Also file a complaint on the first attorney with the state bar association. Your first attorney will have insurance and a second attorney will gladly sue him for all you missed out on, while taking a big cut too.

I used to be an auto claims adjuster for a large insurance company. Unless you signed a release you can still fight for more money. Don't listen to the people that say 'check=done'. I had MANY cases where I would send an initial check for damages then there would be follow up for something else... There are cases where I would request a release of liability to send a FINAL check (in cases of things like diminished value etc...) in which case you are done.

If your lawyer signed something without your consent, that's a different matter. They are set up to represent you and your best interest and it sounds like this guy is a turd. Call the insurance company and be ready to get angry to speak to someone and find out what happened. You may need to provide them with the letter from your lawyer saying that he has withdrawn from the case. When you are rep'd by a lawyer, the insurance company more than likely won't speak to you without your lawyer present or recording you (to cover their butts when someone tries to say they were offered something or were told there was a specific outcome etc...).

You are owed the value of your bike, your medical bills, and any lost earnings due to the accident. Don't just give up.

There are numerous attoneys/law firms out there that deal specifically with injured cyclists, and many of these attorneys are cyclists themselves. They "get it," and will fight for you.

If you haven't signed your rights away by now, an excellent place to start would be former Olympian and pro Bob Mionske, who also writes a legal column for Velo News. I was once rear-ended and injured by a motorist, and although Bob didn't practice in my jurisdiction he still spoke to me over the phone at length and gave me some excellent advice on how to proceed with a local attorney.

Are you sure the driver has insurance? It was proven that he was at fault and I don't see why an insurance would balk at would be a relatively small settlement. If they were taken to court they would pay far more in legal fees.

First, do you have auto or health insurance? It may seem odd but since you were hit by someone driving a motor vehicle and their insurance is who will/should be paying for your damages, your own auto insurance company will/should cover your expenses temporarily, until they can get the money out of the driver's insurance company. Given that you received a concussion, you are also due some amount of a pain and suffering settlement.

I was hit biking to work and fractured two vertebrae in my back about 10 years ago. The driver's insurance covered every penny of my medical bills (including an ambulance ride), full retail value of my custom-built bike, all of my lost time from work, and gave me a settlement check without any negotiating on my part.

That you have/had a lawyer involved and got so little tells me that something is going very wrong in your situation. It is also strange that you had any contact with the driver after the event. You and/or your lawyer should be dealing with your and/or their insurance company only.

What was the car cycling? Trenbolone or some type of SARMs?
