Yes, but don't expect anybody to make this obvious point.
What we really need to know is how many hours Uber self-driving cars have logged and how many pedestrians have been hit per driving-hour compared to a similar statistic for human operated cars.
In this specific instance, we also need to know more about the woman who was hit - all we know right now (according to the article) is that she was 'near' but not inside a crosswalk at an intersection.
Uber certainly may be to blame here, and I definitely think that some of their non-self-driving business practices are unethical. But, we need to know more before evaluating the self-driving technology.
Uber uses forced arbitration. If this pedestrian had download the Uber app, or clicked through the Uber terms of service, it’s an open question whether Uber could force her or her family into forced arbitration to resolve “any claim” including one for injury or death. Uber uses a very expansive reach of forced arbitration.
While this is admittedly an open question, the answer depends on how Uber drafted their arbitration clause. Companies shouldn’t be able to avoid accountability so easily.
When no one is accountable, no one is safe.

There's a wrecked bicycle at the scene, so the story is incomplete, if not incorrect. Was the victim walking the bike or riding? What matters is if would have been avoidable to a normal car and driver, and we won't learn that anytime soon, if ever.

Now I did read the article. It has a picture of the crumpled bike. The other article I read didn't say the woman was on foot, and noted the bike. It's possible the Jalopnik one isn't correct.

The TV news just said that she was walking the bike when she was hit.
There's an update at the bottom that says she was pushing the bike. I didn't catch that before. Big whoop. I wasn't jumping to any conclusions about fault based on that, so why the hate?
