In the still picture it does look like the far right receiver is off the line. HOWEVER, if you watch the entire play, the right side receiver checks-in with the down judge prior to Foles going into motion. Receivers do this on every play in order to make sure they are lined up correctly. If the down judge oks the formation after the check-in, the formation is legal. In the video of the entire play, you can clearly see the right side receiver checking in at :07 sec, :09 sec, and at :14 sec.
Not an illegal formation or play. If the Pats can dish out questionable plays, they should be able to take them.
Alshon Jeffery lined up and signaled to the ref asking if his position was ok. The ref said yes, so he didn't move, and they ran the play in the approved formation. Are the refs supposed to throw a flag AFTER they said the formation was ok as is?
Could you imagine the controversy if a ref lied to Jeffery to trick him into an illegal formation?

Well the guy who said the play could be illegal is the former NFL supervisor of officials so I think he has some cred.
But as the article notes, it is a judgment call to a large extent. As noted, the WR checked with the official that he was lined up. The defense can see that as well.
You say they will rarely call it and then some will, some won't. If it is rare, then few would call it.
Nice try conspiracy theorists. You are better off just watching for missed holding calls on every play.
Seemed to me that this was the first Pats game in quite a while where the Pats were not blatantly helped by the refs. I kept waiting for the refs to toss a flag in the patriots favor in a critical situation as they did so often in the Pats v. Jags game. Or to overturn one of the touchdowns on replay. I was surprised it didn't happen and goes to show that the Pats really need the refs to help them win games.

That is a gross mischaracterization - you’re as bad as the OP.
The only way the flag is thrown is if the sideline official doesn't OK the outside receiver before the snap.
If he doesn't signal OK, then the receiver would move up until the OK is given.
The next person at the end of the line was the offensive tackle with an ineligible #65.
They won't cover that person unless they declared as eligible.
So the formation was not deceiving.

You might as well freeze frame every single play right before the snap to verify that no split end lined up off the line the entire game.
So over a week after the game was played, you are complaining about a non-call (where the receiver checked with the line judge and got an okay?)? Sour grapes much? Where was the outrage as it was happening, or immediately after the game? Let's watch film of every play in the game and see how many non-calls went in the Patriots favor (I can think of at least two intentional grounding penalties and two picks by the Pats that weren't called).
You really have to watch it many times to see how well done that play was. Watch Foles and how he stops suddenly at the line looking like his part of the play is over.

But the tuck rule was a real rule, and the call was correctly made in accordance with it. It was still a rule for 10+ years after that game.

So this actually was called an incomplete pass because Brady didn't tuck the ball after making a pump fake and then having the ball knocked out of his hand to the ground and recovered by the Raiders.
It was initially ruled a fumble, then overturned and called an incomplete pass.
With the Patriots down by 3 and less than two minutes remaining, the Raiders would have won the game and the Patriots obviously would have been eliminated from the playoffs.
The overturn allowed the Patriots to eventually kick the game tying field goal. They then won in OT.
Looks like NE got a taste of their own medicine...
